1 Acceptance of Terms

By accessing or using the BookNExplore website at www.booknexplore.com (the "Platform"), submitting an enquiry, or creating an account, you ("User", "you", "your") agree to be legally bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated into these Terms by reference.

These Terms constitute a legally binding agreement between you and BookNExplore ("we", "us", "our", "Company"). If you are using the Platform on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

If you do not agree to any part of these Terms, you must immediately cease using the Platform.

2 About BookNExplore

BookNExplore is an online travel marketplace that operates as an intermediary platform. Our role is to:

• List and showcase tour packages and destinations curated from partner travel agencies
• Receive travel enquiries from users and match them with relevant verified agencies
• Facilitate communication between travellers and travel agencies
• Provide a platform for users to compare agency offerings and preferences

3 Eligibility

To use the BookNExplore Platform, you must:

• Be at least 18 years of age
• Be legally capable of entering into a binding contract under the Indian Contract Act, 1872
• Not be a person barred from using the Platform under applicable law
• Provide accurate, truthful, and complete information when submitting enquiries or creating an account

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements. If you are submitting an enquiry on behalf of a group, you represent that you are authorised to act on behalf of all members of that group.

4 User Account

While some features of our Platform may be accessed without registration, creating an account allows you to track your enquiries, save preferences, and receive personalised recommendations.

4.1 Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must not share your account with any other person
• You must notify us immediately at support@booknexplore.com if you suspect any unauthorised use of your account
• You are liable for all activity that occurs under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have violated these Terms or if your account has been compromised. You may also delete your account at any time by contacting us.

5 Use of the Platform

You agree to use the BookNExplore Platform only for lawful purposes and in accordance with these Terms. You may use the Platform to:

• Browse destinations and tour packages listed by partner agencies
• Submit travel enquiries to receive quotes from verified agencies
• Compare agency offerings and make informed travel decisions
• Contact our support team with questions or feedback

You agree NOT to use the Platform in any way that is described in Section 10 (Prohibited Conduct).

6 Enquiries & Quotes

6.1 How Enquiries Work

When you submit a travel enquiry through BookNExplore, you authorise us to share your contact details and travel preferences with a shortlisted set of verified partner agencies. These agencies will then provide you with personalised quotes based on your requirements.

6.2 Nature of Quotes

All prices and quotes provided by agencies through our Platform are:

• Indicative and subject to availability at the time of confirmation
• Provided directly by the respective travel agency, not by BookNExplore
• Not guaranteed until you receive written confirmation directly from the agency
• Exclusive of taxes, surcharges, and additional costs unless explicitly stated by the agency

6.3 Price Ranges Displayed

Any price ranges shown on the BookNExplore Platform (e.g., "Agencies from ₹15K–₹35K") are indicative market estimates based on historical data from our partner agencies. These are not quotes, offers, or guarantees. Actual prices may vary based on dates, group size, customisation, and agency availability.

7 Relationship with Agencies

BookNExplore acts solely as a marketplace and intermediary. The following applies to all bookings made through or facilitated by our Platform:

Once you proceed to book with an agency, your contractual relationship is exclusively with that agency. BookNExplore is not a party to that contract and accepts no liability arising from it.

We strongly recommend that you read the terms, conditions, and cancellation policies of any agency before making a booking and before making any payment.

8 Payments & Fees

8.1 BookNExplore Is Free to Use for Travellers

Submitting enquiries, receiving quotes, and using the BookNExplore Platform is completely free of charge for travellers. We do not charge any booking fees, service fees, or commissions to you.

8.2 Payments to Agencies

All payments for travel services are made directly to the travel agency — not to BookNExplore. We are not responsible for:

• The collection, processing, or security of payments made to agencies
• Disputes arising from payments made to agencies
• Any losses arising from fraudulent agencies (though we take all reasonable steps to verify partners)

8.3 Our Revenue Model

BookNExplore earns revenue through referral fees or subscription fees paid by partner travel agencies for being listed and matched on our platform. This does not affect the prices quoted to you by agencies.

9 Cancellation & Refunds

BookNExplore does not operate tours and therefore does not maintain a cancellation or refund policy for travel services. All cancellation and refund matters are governed by the terms of the individual agency you have booked with.

9.1 Your Responsibilities

• Review the cancellation policy of the agency thoroughly before booking
• Request the agency's cancellation terms in writing prior to making any payment
• Notify the agency directly in case you need to cancel or modify a booking

9.2 BookNExplore's Role in Disputes

While we have no contractual obligation to mediate disputes between travellers and agencies, we take the quality of our partner agencies seriously. If you have a complaint about an agency listed on our platform, please contact us at support@booknexplore.com and we will investigate and take appropriate action, which may include removing the agency from our platform.

10 Prohibited Conduct

You agree not to engage in any of the following when using the BookNExplore Platform:

• Submit false, misleading, or fraudulent enquiries or information
• Impersonate any person, business, or entity
• Use the Platform to spam, solicit, or contact agencies for purposes unrelated to travel
• Attempt to bypass or circumvent our platform to contact agencies you discovered through us without using our service
• Scrape, copy, or reproduce platform content, listings, or agency data without written consent
• Use automated tools, bots, or scripts to access the Platform
• Interfere with or disrupt the security, integrity, or operation of our Platform
• Post or transmit any content that is defamatory, obscene, offensive, or in violation of any applicable law
• Use the Platform in any way that could damage our reputation or the reputation of any agency listed on our Platform
• Violate any applicable local, state, national, or international law or regulation

Violation of these prohibitions may result in immediate suspension of your access to the Platform, legal action, or both.

11 Intellectual Property

All content on the BookNExplore Platform — including but not limited to the name, logo, website design, text, graphics, destination descriptions, and software — is owned by or licensed to BookNExplore and is protected under applicable Indian copyright, trademark, and intellectual property laws.

11.1 What You May Do

• View and use the Platform for personal, non-commercial purposes
• Share links to BookNExplore pages on social media
• Print or download content for your own personal reference

11.2 What You May Not Do

• Reproduce, republish, or distribute any Platform content without written permission
• Use the BookNExplore name, logo, or branding without prior written consent
• Create derivative works based on our content
• Use our content for commercial purposes without a licence agreement

12 Disclaimers

To the fullest extent permitted by applicable law, BookNExplore makes the following disclaimers:

12.1 Platform Provided "As Is"

The BookNExplore Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, completeness, or suitability of any information on the Platform.

12.2 Agency Content

Package descriptions, itineraries, inclusions, images, and other content relating to travel agencies are provided by those agencies. BookNExplore does not independently verify the accuracy of all agency-provided content and is not responsible for any inaccuracies or misrepresentations made by agencies.

12.3 No Guarantee of Agency Performance

While we verify and vet all partner agencies, BookNExplore does not guarantee the performance, conduct, or quality of any travel agency listed on our platform. We are not liable for any failure by an agency to deliver its services as promised.

12.4 Travel Risks

Travel inherently involves risks. BookNExplore is not responsible for any injury, illness, death, damage, loss, accident, delay, or other harm that may arise during travel. We strongly recommend that all travellers obtain comprehensive travel insurance before any trip.

13 Limitation of Liability

To the maximum extent permitted by applicable Indian law, BookNExplore, its directors, employees, agents, and partners shall not be liable for any:

• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunity
• Damages arising from your reliance on information provided on the Platform
• Damages arising from the acts or omissions of any travel agency
• Damages arising from unauthorised access to or alteration of your data
• Damages arising from any interruption, suspension, or termination of the Platform

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

14 Indemnification

You agree to indemnify, defend, and hold harmless BookNExplore and its directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of or inability to use the Platform
• Your breach of these Terms
• Your violation of any applicable law or the rights of any third party
• Any false or misleading information you provide through the Platform
• Any dispute between you and a travel agency

15 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

15.1 Dispute Resolution Process

In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform, the parties shall attempt to resolve the matter through the following process:

1. Informal Resolution: Contact us at legal@booknexplore.com. We will attempt to resolve the dispute informally within 30 days.
2. Mediation: If informal resolution fails, either party may request mediation through a mutually agreed mediator.
3. Arbitration: If mediation fails, the dispute shall be referred to a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be New Delhi, India. The language of arbitration shall be English.

15.2 Jurisdiction

Subject to the arbitration clause above, you agree that the courts of New Delhi, India shall have exclusive jurisdiction over any disputes that are not subject to arbitration.

16 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify registered users by email at least 14 days before changes take effect
• Display a prominent notice on our Platform for 30 days following the change

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.

We encourage you to review these Terms periodically to stay informed of your rights and responsibilities.
